Without limiting the foregoing, the Services are not permitted to be used by minors (meaning, in most jurisdictions, people under the age of 18) or temporarily or indefinitely suspended SawariyaGem members. Your use of the SawariyaGem Website represents and warrants that you have the right, authority, and ability to enter into this Agreement and comply with all terms and conditions of this Agreement.
The SawariyaGem website is for the personal use of individual members, and may not be used in connection with any commercial endeavor unless registered and approved as an ‘affiliate’ of SawariyaGem. Commercial endeavors include providing links to other websites, whether competitive to SaawariyaGem or otherwise. Illegal and/or unauthorized use of the Website, including unauthorized creation of or linking to the Website, will be investigated, and appropriate legal action will be taken, including, without limitation, civil, criminal, and injunctive redress. SawariyaGem shall be entitled to recover from you, your heirs, heirs, assignees, etc. any profits, revenues, profits, etc., which you have received, expected, or 50% of such profit with a fine going to receive revenue/profit from unauthorized use of this site.
Your subscription is for personal use only. It is not to be assigned, transferred, or licensed for use by any other person/entity. Members are advised to make proper/ thorough inquiries before acting on any service advertisement. Our website does not endorse or subscribe to claims and representations made by advertisers. Please note that your membership in SaawariyaGem is for your sole, personal use. You may not authorize others to use your subscription and you may not assign or transfer your account to any other person or entity.
As long as you use and/or are a member of the Website, this Agreement will remain in full force and effect. You may terminate your membership and/or membership at any time by notifying SavariyaGem in writing to terminate your membership. If you terminate your subscription, you will not be entitled to a refund of any unused subscription fees or access to digital content or reports purchased through SawariyaGem. SawariyaGem may terminate your membership and/or membership by sending you a notice to the email address you provided in your application for membership, or such other email address that you may subsequently provide to SawariyaGem.
If SawariyaGem terminates your subscription to the Service because you have violated this Agreement, you will not be entitled to any refund of unused subscription fees. All decisions regarding the termination of accounts will be made at the sole discretion of SawariyaGem. SawariyaGem does not require you to give notice prior to your membership and/or termination of membership. SawariyaGem is not required and may be restricted from disclosing the reason for the termination of your account. Even after your subscription or subscription expires, this Agreement will remain in effect. All Terms which by their nature may survive termination of this Agreement shall be deemed to have survived such termination.
While providing the Services, SawariyaGem may outsource any part thereof to any competent person or organization, with or without disclosing the same to you. However, your membership rights and responsibilities are against SavariyaGem only and not against such individuals or organizations.
a) SawariyaGem owns and holds all proprietary rights in the Service. The Website contains copyrighted material, trademarks, and other proprietary information of SawariaGem, and its licensors. You may not copy, modify, publish, transmit, distribute, perform, display or sell any such proprietary information, except for the information that is in the public domain or for which you have been given permission. Any such act or attempt to do so on your part will be a breach of this Agreement and your membership may be terminated forthwith by SawariyGem without refund of any unused membership fees.
b) Reliance on materials, advice, opinions, statements, offers, or other information or materials made available through the SawariyaGem Service or the SawariyaGem Website, but not directly by SawariyaGem, are their respective authors, and should not be relied upon. Such authors are solely responsible for such content.
SawariyaGem does not:
(i) guarantees the accuracy, completeness, or usefulness of any information on the Service, or
(ii) adopt, endorse or accept responsibility for the accuracy or reliability of any opinion, advice, or statement made by any party appearing on the Website.
Under no circumstances will SawariyaGem or its affiliates be liable for any loss or damage caused by reliance on information or other material posted on the Website or transmitted to or by any Member. No advice, opinion, or other information or material provided by SawariaGem directly through the advice section, user forum, or community forum should be relied upon.

Under no circumstances will SawariyaGem or its affiliates be liable for any loss or damage caused by reliance on information or other material posted on the Website or transmitted to or by any member.

Please note that this Agreement strictly limits our liability and does not provide a warranty for the SawariyaGem Service. The contract also limits your treatments

SawariyaGem and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors expressly disclaim all warranties of any kind, whether express or implied, whether limited to, be limited, whether limited, whether to the extent or applicable, which includes, Objective and non-infringing.

You agree that SawariyaGem will not be liable to You or any third party for any modification, suspension, or discontinuance of the Service.
If by using the Site there is any dispute regarding or involving the Site and/or the Service, you unconditionally agree that all such disputes and/or differences shall be governed by the laws of India and shall be subject to the exclusive jurisdiction. Competent Court only at Delhi, India.
You agree to indemnify and hold SawariyaGem, its subsidiaries, affiliates, officers, agents, and other partners and employees, harmless from any damages, liability, claim, or demand, including reasonable attorney’s fees, from any third party arising out of your use of the Service by or caused by your use of the Service in breach of this Agreement and/or arising out of your breach of this Agreement and/or any breach of your representations and warranties, set out above.
You agree that, except as otherwise expressly provided in this Agreement, there shall be no third-party beneficiaries to this Agreement.
Any correspondence or business dealings with advertisers found on or through the Service, or participation in promotions, including payment for and delivery of related goods or services, and any other terms, conditions associated with such dealings warranties or representations, are solely between you and such advertiser. You agree that SawariyaGem will not be responsible or liable for any loss or damage of any kind as a result of any such transaction or the presence of such advertisers on the Service.
This Agreement constitutes the entire agreement between you and SawariaGem in relation to your use of the Website and/or the Service. If any provision of this Agreement is held invalid, the remainder of this Agreement shall remain in full force and effect. You are obliged to report any misuse or abuse of the Site. If you notice any misuse or abuse of the Site or anything that violates this Agreement, you shall immediately report such violation to SawariaGem by writing to Customer Service. Upon receipt of such complaint, SawariyaGem may investigate such complaint and, if necessary, terminate the membership of the member responsible for the misuse or abuse of such violation without refund of the membership fee. Any false complaint made by a member will make such member liable to terminate his membership without a refund of the membership fee.
